LATTIMORE, Judge.

— Appellant was convicted in the Criminal District Court of Dallas County of the offense of selling intoxicating liquor, and his punishment fixed at one year in the- penitentiary.

Complaint is made of the refusal of the trial court to require the State to try one S. H. Hill before proceeding with the trial of appellant. Appellant presented this in the form of a written request in -which it was stated that S. H. Hill was indicted in cause No. 6464 entitled The State of Texas vs. S. H. Hill, for an offense growing out of the same transaction involved in the instant prosecution,…
