Cummins, J.,

Plaintiff brought a civil suit in assumpsit against defendant before *265Alderman John P. Carmichael, now deceased. The amount involved was $250 and judgment was found for plaintiff in that amount. Defendant appealed the alderman’s judgment to the court of common pleas, where after the filing of a complaint, an answer raising new matter and a reply, the taking of a deposition in the State of California and a pretrial conference, in accordance with a stipulation of counsel, the matter was tried by the court without a jury.
