Appeal by the defendant from a judgment of the Supreme Court, Queens County (Friedmann, J.), rendered January 13, 1989, convicting him of robbery in the third degree, grand larceny in the third degree, grand larceny in the fourth degree, criminal possession of stolen property in the third degree, unauthorized use of a vehicle in the third degree, and criminal mischief in the fourth degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is reversed, on the law, and as a matter of discretion in the interest of justice, the first and sixth counts of the indictment charging…
