This case has been elaborately and ably argued, and I proceed with all possible brevity to announce the-conclusion which the court has attained upon the questions presented.
And, first, as to the manner in which this court shall take-cognizance of the petitioners’ application, so as not to render its proceeding obnoxious to the provision of the constitution, which denies to it any other than appellate jurisdiction.
