— The facts in this case, which are practically undisputed, are substantially as follows: The plaintiff brought a foreclosure action against W. S. Hart-, and obtained a judgment; the land was sold, and a sheriff’s certificate issued to the plaintiff under date of November 27, 1925. Within the proper time, the defendant William S. Hart redeemed from said foreclosure by paying to the clerk of the district court $8,617.89, plus certain costs. This payment was made by turning over to the clerk a draft for $8,000, and also a check for $617.89. The clerk, on receipt of the same, notified one…
