Background

This ease arises out of New York City’s effort to rid the City’s commercial carting industry of “organized crime’s corrupting influence.” Local Law 42 of 1996, Section 1. To effectuate this aim, Local Law 42 created a new regulatory agency, the New York Trade Waste Commission (“Commission”) 1 and established a new structure for licensing and overseeing commercial carters in order to loosen the mob-run cartel’s grip on the industry.
