We have granted the State’s petition' for further review pursuant to Neb. Rev. Stat. § 24-1107 (Cum. Supp. 1994). The State appeals the Court of Appeals’ decision reversing and remanding for new trial the conviction by jury of Gregory T. Neujahr for knowingly or intentionally possessing a controlled substance in violation of Neb. Rev. Stat. § 28-416(3) (Cum. Supp. 1992). The Court of Appeals found the trial court erred in not properly instructing the jury regarding Neujahr’s claim that he did not know the pills in his pocket were a controlled substance and in admitting certain hearsay…
