Owen, J.

Plaintiff in error, (hereinafter called the defendant) was convicted of murder in the first degree. The sufficiency of the evidence to support the verdict is not challenged. The errors which it is claimed require a reversal *186of the judgment are those arising during the course.of the trial. The most important and conclusive of these presents the question of the constitutionality of sec. 357.12, Stats., appearing in the margin.1
