This cause was argued and submitted on October 6, 1920, and an opinion written by-Mr. Justice Burnett affirming the decree of the Circuit Court was handed down on November 9, 1920. In that opinion we declined to consider the testimony in the case for the reason that such testimony had not been filed with the clerk of the Circuit Court or authenticated by the circuit judge as required by law.
