The appellant was indicted in the Desha Circuit Court for the 'crime of murder in the first degree in the killing of one Jim Osborne. The testimony tended to prove that on the night of June 12, 1924, a negro by the name of “James” robbed one B. Smith in the town of Gould, Lincoln County, Arkansas. Smith related the occurrence to Jim Osborne, an officer, who, on the following morning about seven o’clock went to the home of Isaac Parker in search of “James.” As he approached the home of Parker, he was shot with a double barrel shotgun and died from the effects of the wounds.
