Appeal from special term, Delaware county. Action by Isaac J. Squire against Otis H. Preston and others, as president and trustees of the village of Roxbury, to set aside a certain tax warrant issued by defendants, and to restrain the -collection by them of the annual" tax levy. From an order dismissing his complaint, plaintiff appeals.

This case presents another phase of a litigation that was before this court in Squire v. Cartwright, 67 Hun, 218, 22 N. Y. Supp. 899. That was an action to restrain the collection of a special tax levied in October, 1890, which, among other things, contained an item for rent of water hydrants under a contract made by the president and trustees of the village with the water company on August 15, 1890.
