On September 30, 1912, the appellee, Edgar Smith, instituted this suit in the county court of Hopkins county against the appellant to recover the sum of $498 as damages to a shipment of cattle. The petition, in substance, states that the plaintiff resides in Hopkins county, Tex., and that the defendant, the Missouri, Kansas Texas Railway Company of Texas, is a corporation existing under and by virtue of the laws of the state of Texas, and has a local agent residing in Hopkins county, Tex.; that it is a common carrier, and has a line of railroad running from Winnsboro, Wood county, Tex., to…
