In August 2006, defendant was convicted in Michigan of accosting a child for immoral purposes and three counts of criminal sexual conduct. It is undisputed that in April 2012, after completing his prison term for the underlying sex offenses, defendant was released from custody without supervision. Defendant relocated to New York, and six months later, in October 2012, he was arrested for failing to register as a sex offender, in violation of federal law (18 USC § 2250).
