This matter is before the court on a motion for declaratory judgment filed by the plaintiff pursuant to Section 8.01-184 of the Code. The matter has been presented to the court on a "Stipulation of Facts" made by counsel and filed herein. Counsel have further made oral argument to the court and have submitted memoranda in support of their positions.
