Lebedeff, J.), entered April 30, 2004, which denied the petition brought pursuant to CPLR article 78 to annul a determination by respondent New York State Division of Housing and Community Renewal (DHCR), dated July 11, 2003, which affirmed an order of the Rent Administrator that denied petitioner’s application for a substantial rehabilitation exemption from rent stabilization, unanimously affirmed, without costs.
