MARQUEZ, Senior District Judge.

Before the Court is Defendants’ Motion to Dismiss Plaintiffs Complaint in accordance with Rule 12(b) of the Federal Rules of Civil Procedure on the following grounds: lack of subject matter jurisdiction, lack of personal jurisdiction, improper venue and failure of Plaintiff to state a claim upon which relief can be granted. For reasons stated below, the Court grants Defendants’ Motion to Dismiss for lack of subject matter jurisdiction under Rule 12(h)(3) because the Plaintiff lacks standing to bring these causes of action.
