The plaintiff, in his petition for injunction and damages on account of a nuisance, alleged, that he was 67 years old and his wife about 65; that they resided in a leased home, on which they had paid the rent four years in advance, with the privilege of renewal; that directly across the street, about 60 feet from their residence, the defendant owned and operated for profit, with a charge for admission, a field or park for playing baseball games on week nights from Mondays through Fridays, beginning at about 8 and continuing “until 11, 12, and sometimes past midnight,” and on…
