Mason, J.:

F. W. Martin sued the Weigand Tea & Coffee Company, a partnership, for damages caused by an automobile driven west by the plaintiff being run into at a street intersection by a car of the defendants’ driven south. Judgment was rendered for the plaintiff and the defendants appeal.

The collision took place a little west of the middle of the north and south street. By ordinance the plaintiff had the right of way. Another ordinance required the driver of an automobile to give a reasonable warning of its approach, by bell or horn, upon passing the…
