OPINION
RODRIGUEZ, District Judge.
This matter is before the court on Defendants’ motion to dismiss Plaintiffs Complaint for his failure to file an affidavit of merit as required by New Jersey’s Affidavit of Merit Statute. The Court has considered the submissions of the parties and heard oral argument on the record on Wednesday, May 5, 2004. The Court hereby incorporates the record created during the oral argument on this motion, and further relies on the reasons expressed on the record at that time.
