LAND, J.

Plaintiff sued the defendant for $63,000, damages alleged to have resulted from the failure of the defendant to deliver a large number of cut and deadened cypress trees pursuant to a contract of sale made in March, 1902.

The defendant answered, denying that it ever made or authorized or ratified the alleged contract of sale, and, in the alternative, pleaded that, if its president had authority to bind the corporation by such contract, owing to the fact that there was doubt as to the title of the defendant to the timber or the fact that the defendant desired to make a sale…
