.FOSTER, J.

The appellant (defendant in the court below) was convicted for violation 'Of the prohibition laws. .The first count in the indictment charged the manufacture of prohibited liquors, and the second count charged the unlawful possession of a still.

The evidence for the state was directed to showing that the sheriff and two others found four barrels of sorghum beer, a furnace with coals in it, having the appearance of being operated a short time before, and a wooden worm three quarters of a mile or more from the defendant’s house, wagon tracks leading from the defendant’s house within…
