The Phoenix Insurance Company issued to E. T. Gray a policy of fire-insurance for $1,525, covering a building and the furnitpre therein. In the policy was a stipulation that, unless otherwise provided by agreement endorsed' thereon or added thereto, it should “be void if the insured now has or shall hereafter make or procure any other contract ■of insurance, whether valid or not, on the property covered in whole or in part by this policy.” The property insured was consumed by fire, and Gray brought his action against the insurance company.
