Appeal from special term, Warren county. Action by the Glens Falls Gaslight Company against Benjamin Van Vranken and James Duell. Judgment for defendants, on a trial to the court, and plaintiff appeals.

In June, 1854, the plaintiff was duly incorporated under the provisions of chapter 37 of the Laws of 1848, entitled “An act to authorize the formation of gaslight companies.” Its object was the manufacture and sale of gas for the purpose of lighting the streets and public and private buildings in the village of Glens Falls, and the term of its existence was 50 years. Soon after its incorporation, and with the consent of the municipal authorities of the village, it laid down a system of gas pipes in the streets of the village, and since that time it has been engaged in manufacturing gas, and…
