On August 1, 2012, Irving H. Picard (“the Trustee”), the trustee appointed under the Securities Investor Protection Act (“SIPA”), 15 U.S.C. § 78aaa et seq., to administer the bankruptcy estate of Bernard L. Madoff Investment Securities LLC (“Madoff Securities”), commenced this action seeking to enjoin the defendants from consummating a $410 million settlement of claims brought by the New York Attorney General (“NYAG”) against various other defendants and to stay the underlying lawsuits that produced the settlement.
