The facts in this case are as follows:.
Defendant is the owner of an iron mine, from which large quantities of ore are taken by means of the equipment usually connected with and necessary to the operation of such enterprises. Defendant maintained at the one hundred foot level of its mine a tram railway track on which tram cars were operated from various parts thereof to the shaft where the ore was elevated to the surface.
