This is an appeal from a trial court judgment dismissing plaintiff’s suit for damages. For the following reasons, we affirm.
FACTS AND PROCEDURAL HISTORY
Plaintiff, Raymond Rochon, was tried and convicted of aggravated rape in violation of Louisiana Revised Statutes 14:42 on December 6-7, 1979. Thereafter, he was sentenced to life imprisonment, in the custody of the Department of Corrections (DOC), without the benefit of probation, parole or suspension of sentence for a period of 40 years.
