This is an appeal from a summary judgment in the above entitled cause in favor of the defendants, in the district court of the sixth judicial district of the State of Montana.

We are not here concerned with procedural matters, but rather whether the district judge properly ruled on facts presented to the court. Prior to Judge McKinnon’s finding for the defendants, in this matter, District Judge George Allen had held a hearing on an order to show cause at which hearing evidence was taken.
