' This was an action of covenant brought in the circuit court of Wood county in 1879 by Franklin Rex against tlie heirs of Bushrod W. Creel, deceased, claiming fifty thousand dollars damages for breach of general warranty of title. The defendants demurred to the declaration and each count thereof, in which demurrer the plaintiff joined. On the 18th day of October, 1879, the court sustained the demurrer- and remanded the case to rules with leave to amend the declaration.
