I respectfully disagree with the conclusion of the majority in reversing the judgment of the trial court. By so doing it vitiates the Environmental Protection Act (sec. 1.11, Stats.) in Wisconsin and approves the sorry record of the Department of Industry, Labor and Human Relations (DILHR) in refusing to conform with the legislative mandates, executive orders, and guidelines designed to protect the environment and to facilitate administration of the act.
