Affirming.

Bernard D. Holbrook, a child four years old, was struck and killed by a truck operated by Lutber Grigsby. Tbe accident happened on Sunday afternoon September 19, 1937, between 4 and 5 o’clock on the Mayo trail between Ashland and Louisa, Kentucky. Denver Holbrook, father of Bernard Holbrook, qualified as ad- • ministrator of the deceased child’s estate, and brought this action against W. R. Yansant and W. R. Yansant, Jr., partners doing business as W. R. Yansant & Son, to recover damages for the child’s death.
