WHITHAM, Justice.
Appellant appeals from a conviction for theft of property of the value of $200 or more but less than $10,000 in which punishment, enhanced, was assessed by the court at life in the Texas Department of Corrections. Appellant asserted two grounds of error, but at oral argument waived the second. In his first ground of error appellant contends that “the evidence is insufficient to show a crime of theft in that the evidence shows at most a mere breach of contract.” Because the evidence is insufficient to show theft, we conclude that appellant was sentenced to life in the…
