MOORE, Circuit Judge.
Harold W. St. Clair died on November 1,1949, when the Eastern Air Lines plane in which he was a passenger collided in mid-air over Washington, D. C., with a Bolivian P-38 military aircraft. Josephine St. Clair, as executrix of her deceased husband’s estate, brought separate suits for wrongful death against the United States and Eastern Air Lines, Inc. (Eastern), in the United States District Court for the Southern District of New York.
