Frank Goodwin was tried for lunacy' under the provisions of R. S. 1925, title 92, arts. 5550 to 5561. The jury answered the first statutory issue “Yes,” and the second “No”; that is to say, they answered that Frank Goodwin was of unsound mind, but that it was not necessary that he be placed under restraint. It was further found that the defendant was 59 years of age, and was the owner of property of the value of $9,000. Upon these findings the county court, on December 10, 1930, adjudged the said Frank Goodwin to be of unsound mind, and awarded against him recovery of the costs of the…
