In 2005, Howard Thaler (“Petitioner”) was convicted, following a jury trial before Judge Charles L. Brieant, Jr., of nine substantive counts of mail fraud, wire fraud, and making false statements and one count of conspiracy to make false statements and commit mail fraud, all in connection with a series of real estate transactions.
