BINGHAM, Circuit Judge.

This is an action of tort brought to recover damages for personal injuries sustained by the plaintiff on the 7th day of October, 1918, through the negligence of the defendant wherein her right leg was injured, necessitating amputation at or near the knee.

The action was brought in the District Court of San Juan, January 24, 1919. August 9, 1920, that court found a verdict and entered judgment in favor of the plaintiff. An appeal was taken to the Supreme Court of Puerto Rico, and on April 17, 1923, the judgment appealed from was reversed, and the ease remanded with leave…
