J. E. Chapman brought suit against the County of Elbert, alleging, that he was the owner of a certain tract of land in said county, containing 53 acres, more or less, which lay adjacent to and bordering on the old public road leading from Euckersville and Elberton to Hartwell, and that “some time during the year 1910” the defendant, through'its officers, agents and employees, “altered” the said old road, and constructed a new public road which passed by the lands of the plaintiff at a distance of half a mile; that on or about November 15, 1910, one Jack Wandsley, by the consent of the…
