Petitioner was convicted on his plea of guilty and sentenced to life imprisonment on a Texas charge of rape. Subsequently he filed a petition for writ of habeas corpus relief in the State trial court alleging that his plea had been induced by an unkept promise of the District Attorney that he would receive a five year sentence if he would enter a plea of guilty. The trial court’s dismissal of the petition without an evidentiary hearing or even any response being filed by the State was accepted by the Texas Court of Criminal Appeals.
