Instructions were duly asked by the defendant directing the jury to find it not guilty, which were refused. It is insisted that this ruling constituted feversible error. The count of the declaration under which the recovery was had charged the appellant with negligence in failing to operate its gates as required by the ordinances of the city of Springfield. The record shows that the city had passed an ordinance requiring appellant to erect gates at the crossing in question and operate them both day and night.
