OPINION AND ORDER

LAFFITTE, District Judge.

The United States of America brings this class action pursuant to 33 U.S.C. §§ 403 and 409. It seeks injunctive relief to compel Defendants, owners of houseboats or “floating structures” in the La Parguera area of Lajas, Puerto Rico, to remove their house boats from La Parguera. In an order dated September 20, 1995, the Court granted the Government’s request to certify this case as a class action and divided the defendant class into a Subclass A and a Subclass B. 1 Subclass A is made up of all present and future owners of houseboats in La Parguera who…
