O. W. McClung, hereinafter referred to as the defendant, was arrested on a warrant charging that he had commenced to erect on February 25, 1958, after his building permit had expired, a veterinary hospital building on land owned by him in Henrico County, Virginia, in violation of the county zoning ordinance, as amended. He was convicted in the county court and appealed to the circuit court.
