In an action for specific performance of a contract for the sale of certain real property, in which the defendants asserted a counterclaim for return of their deposit, defendants appeal from a judgment of the Supreme Court, Nassau County, entered August 24, 1965 upon the court’s decision, after a nonjury trial, in the plaintiff’s favor and dismissing the defendants’ counterclaim on the merits.
