APPEAL from a judgment of the Superior Court of the County of Maricopa, J. C. Phillips, Judge. STATEMENT OF FACTS BY THE COURT. The appellant is charged and convicted of the willful and deliberate murder of Carl Peterson, committed on the ninth day of September, 1912, by crushing his head with an iron bar or other blunt instrument. The jury returned a verdict of guilty of murder of the first degree and fixed the punishment at death.
