I. BACKGROUND

By Order dated March 7, 2006, Magistrate Judge Andrew Peck, to whom this matter had been referred for pretrial supervision, issued a Report and Recommendation (the “Report”), a copy of which is attached and incorporated herein, recommending that the Court deny the motion of plaintiff James Newman (“Newman”) for certification of a class in this action pursuant to Federal Rule Civil Procedure 23(a), and that this case be remanded to state court.1 Newman filed timely objections to the Report pursuant to Fed.R.Civ.P. 72(b).
