MEMORANDUM OPINION and ORDER
MCBRYDE, District Judge.
On April 22, 2003, came on for trial the claims of Shena Murphy (“Murphy”), individually, and as next friend of Terry Carter (named as “John Doe” in the original petition) (“Carter”) (hereinafter collectively “plaintiffs”), for procedural due process under the United States Constitution. Plaintiffs and defendants, Fort Worth Independent School District (“FWISD”) and Superintendent Thomas Tocco (“Tocco”), appeared by and through their attorneys of record.
