Felton Chief Judge.

The petition charges that the following acts of negligence caused the tragic death of the plaintiff’s five-year-old son: “a. Failure to ascertain if said vehicle could *167be moved with reasonable safety before backing same; b. Failure to use reasonable care in anticipating the presence of small children playing near the automobile; c. Starting a parked vehicle without first ascertaining if same could be moved with reasonable safety; d. Failure to warn said small children by voice or appropriate horn signal before backing said vehicle.”
