I. INTRODUCTION AND FACTUAL BACKGROUND

This ease involves the issue of allocation of defense costs between two insurance companies. The case arises from two separate lawsuits filed by Dr. Sheila Deitz (“Dr.Deitz”) against the University of Denver (“the University”) and others in relation to her denial of tenure, her termination from the post as Director of the Professional Psychology Center, and her ultimate termination from employment with the University.
