M. W. Cockrum brought an action on the case against Theodore C. Keller in the circuit court of Franklin county alleging fraud and deceit in connection with the sale of coal interests. The issue joined upon the plea of not guilty was submitted to the jury. The jury returned a general verdict in favor of the plaintiff below and assessed his damages at $3800. In addition to the general verdict certain interrogatories were submitted, at the request of the parties, to the jury for special findings.
