Findley v. Posway

Appellate Court of Illinois

1Opinion of the Court

PRESIDING JUSTICE WILSON

delivered the opinion of the court:

This is an appeal taken by plaintiff-counterdefendant Daniel N. Findley from an order of the circuit court of Cook County denying the motion of plaintiff to strike the counterclaim of defend ant-counter-plaintiff Cathy Posway. Although it was not brought to this court’s attention by the parties, we observe that we lack jurisdiction to hear this appeal because no final and appealable order was entered by the trial court. For this reason we find it unnecessary to reach the merits of this appeal and the appeal is dismissed.
