Currahee Construction Company (“Currahee”) is a general contractor hired by the Hall County Board of Education (“school board”) to construct a new elementary school. As the contractor, Currahee was required to provide the school board with performance and payment bonds in the contract amount of $2,590,400. During performance of the contract, the school board learned that the bonds provided by Currahee were invalid, and the contract was terminated.
