This was a proceeding under secs. 5 and 6 of the act of March 4th, 1863, 3 Ind. Stat. 413. On the 27th day of April, 1874, in open court, the appellee filed the following motion:

“ Comes now the said plaintiff by Thompson & Thompson, his attorneys, and files his motion herein, to wit:
